16. The Board shall recess into closed session for a conference with legal counsel regarding:

A. Existing litigation in the following matters:

1. Konrad Lockhart v. Los Angeles Department of Water and Power; WCAB Case No. ADJ13014963, pursuant to Section 54956.9(a) of the California Government Code.

2. County of Mono v. City of Los Angeles, Los Angeles Department of Water and Power, Alameda County Superior Court Case No. RG18923377, pursuant to Section 54956.9(a) of the California Government Code.

3. San Diego County Water Authority v. Metropolitan Water District of Southern California, San Francisco Superior Court Case Nos. CPF-10-510830; CPF-12-512466; CPF-14-514004; CPF-16-515282;

CPF-16-515391; CGC-17-563350; California Court of Appeal (1st District) Case Nos. A146901; A148266; A154325; California Supreme Court Case Nos. S243500; S251025; and Los Angeles Superior Court Case No. BS173868, pursuant to Section 54956.9(a) of the California Government Code.

4. Antwon Jones v. City of Los Angeles, Los Angeles Superior Court Case No. BC577267 (and designated related cases), pursuant to Section 54956.9(a) of the California Government Code.

5. Dreher v. Los Angeles Department of Water and Power, Los Angeles Superior Court Case No. 19STCV07272, pursuant to Section 54956.9(a) of the California Government Code.

B. Anticipated litigation in the following matters:

1. Discussion regarding significant exposure to litigation (2 cases), pursuant to Subdivision (d) of Section 54956.9 of the California Government Code, including:

a. Claim of Andrew Mollner, City of Los Angeles Claim File No. C21-01567.

C. Conference with Labor Negotiators: Pursuant to California Government Code Section 54957.6, the Board will meet in closed session with the Department’s labor negotiators (the Department’s General Manager and Chief Engineer and Chief Human Resources Officer) concerning labor negotiations with: International Brotherhood of Electrical Workers, Local 18 Management Employees Association Non-Represented Managers

D. Evaluation of Performance of General Manager: Pursuant to California Government Code Section 54957(b)(1), the Board shall meet in closed session to evaluate the performance of the General Manager.
