K. Items for Approval
1. Recommended by Office of the City Attorney for Water and Power Approval of Legal Services Agreement between the City of Los Angeles, acting by and through the Los Angeles Department of Water and Power, and Kaplan Kirsch & Rockwell, LLP, Agreement No. 47814. The City Attorney’s Office completed a Request for Proposals process and recommends entering into an agreement with Kaplan Kirsch & Rockwell with an initial allotment not to exceed $1,600,000, commencing on May 1, 2024, and terminating on April 30, 2027. Determine item is exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3).
2. Recommended by Office of the General Manager and Chief Engineer Approval of Health Plan Contracts. The Agreements have an estimated cost to Los Angeles Department of Water and Power of $23 Million for active employees, a 9.2 percent increase, and a $30.5 Million for retired employees, a 12.8 percent increase, based on current levels of enrollments. Determine item is exempt pursuant to CEQA Guidelines Section 15060(c)(3).
3. Recommended by Office of the General Manager and Chief Engineer Approval of Agreement No. 47838 for Federal Legislative Consulting Services for Water and Power Utility Advocacy with Van Ness Feldman, LLP.
4. Recommended by Financial Services Organization Approval of Authorization to Enter into a First Amendment to Second Amended and Restated Standby Bond Purchase Agreement (SBPA) and the Related Third Amended and Restated Fee Agreement with Bank of America Under Resolution No. 5051. The proposed SBPA with Bank of America will have a term of approximately three and a half years effective May 2, 2024. The commitment fee rate of 15 basis points or 0.150 percent per annum will yield fees of approximately $332,000 per year or a total of $1,162,000 over the three and a half year term. Determine item is exempt pursuant to CEQA Guidelines Section 15060(c)(3).
5. Recommended by Power System Approval of Letter of Agreement with the International Brotherhood of Electrical Workers, Local 18 Establishing Conditions for the Management of Owner’s Representative Services for Clean Grid LA Projects. Determine item is exempt pursuant to CEQA Guidelines Section 15060(c)(3).
6. Recommended by Power System Approval of Energy Efficiency Savings for Fiscal Year 2022-2023 for Energy Cost Adjustment Calculation Due to Revenue Losses. Determine item is exempt pursuant to CEQA Guidelines Section 15060(c)(3).
