25. The Board shall recess into closed session for a conference with legal counsel regarding:

A. Existing litigation in the following matters:

1. County of Mono v. City of Los Angeles, Los Angeles Department of Water and Power, Alameda County Superior Court Case No. RG18923377, pursuant to Section 54956.9(a) of the California Government Code.

B. Evaluation of Performance of General Manager: Pursuant to California Government Code Section 54957(b)(1), the Board shall meet in closed session to evaluate the performance of the General Manager. The Board shall publicly report any action taken in closed session and the vote or abstention of every member present thereon, in accordance with Section 54957.1 of the California Government Code.
